  85. ~~~~~~~~~~~
  86. 'Software' or 'Program' means the ChaoSoft software product
  87. File Manager Guard (FM Guard), including both the software and the
  88. associated documentation and other materials;
  89.  
  90. 'Unregistered Copy' means a copy of the Program you obtained from
  91. us or other source for evaluation purposes and which is described
  92. as "Unregistered copy" in the 'About' screen. An Unregistered Copy
  93. may be converted to registered one by supplying a name of a
  94. registered user or institution and a correct Registration Code,
  95. which may be obtained from ChaoSoft.
  96.  
  97. 'Registered Copy' means a copy of the Program registered with
  98. ChaoSoft or with its authorized dealer, and which is described as
  99. "Registered to: <user name>" in the 'About' screen. A Registered
  100. Copy may be unregistered by copying it to another disk or
  101. computer, or by removing the registration information from an
  102. initialization file.
  103.  
  104. 'Registration Package' means all the materials you are obtaining
  105. from us after sending us your registration fee. In particular,
  106. Registration Package contains your personal Registration Code,
  107. allowing you to remove the registration reminder message and put
  108. your name in the 'About' screen.
  109.  
  110. 'we' or 'us' means ChaoSoft, a company based in Old Town, Maine, USA;
  111.  
  112. and
  113.  
  114. 'you' means the end user or distributor of the Software.

  116. Legal Agreement.

  118. This is a legal agreement between you and ChaoSoft. By using or
  119. distributing the software you are agreeing to be bound by the
  120. terms of this agreement.

  124. ChaoSoft grants to you the right to use or distribute the Software
  125. under the terms of this agreement. The software is in "use" on a
  126. computer when it is loaded into the temporary memory (i.e., RAM)

  131. The software is NOT a public domain or free program. It is owned
  132. by ChaoSoft and is protected by United States copyright laws and
  133. international treaty provisions. Therefore, you must treat the
  134. Software like any other copyrighted material except that a limited
  135. right to make copies of the Software, subject to conditions of
  136. this license agreement, is granted to you. You may not copy any
  137. written or printed materials from your Registration Package and
  138. you may not rent or lease a Registered Copy of the Software.

  140. TRIAL USE LICENSE

  142. ChaoSoft grants to you a limited license to use an Unregistered
  143. Copy of this software for evaluation purposes for a period not to
  144. exceed 21 days.

  146. This period may be not a contiguous sequence of days. However, you
  147. should count a day as an evaluation day if you used the Program
  148. during that day at least once. The purpose of this evaluation
  149. period is to allow you to determine whether the program meets your
  150. needs before purchasing it.

  152. Once the evaluation period has ended, you MUST either purchase
  153. your copy of the Program through registration, or stop using it.
  154. Use of an Unregistered Copy beyond the end of the evaluation

  159. use your Unregistered Copy beyond the end of the evaluation period

  162. Registering the Program.

  164. To register the Software, you should send your name, address, and
  165. correct amount of registration fee to us or one of our
  166. registration sites. You may use various registration forms
  167. supplied with the documentation to the Software. After getting
  168. your Registration Package from us, containing the Registration
  169. Code assigned to you,  you may use that code to convert your
  170. Unregistered Copy of the Software into Registered one.

  172. You agree to keep the Registration Code for your own use only and
  173. not to share it with anybody else.

  175. REGISTERED COPY USE LICENSE

  177. ChaoSoft grants to you the right to use a Registered Copy of the
  178. software, if you registered it with us and obtained your
  179. Registration Code.

  181. You may install a Registered copy of the software on more than one
  182. computer (for example, desktop system and portable notebook),
  183. provided that you are the only user of those computers and there
  184. is no possibility to use the Registered Copy by anybody else.

  186. You may not network a Registered Copy or otherwise use it on more
  187. than one computer or computer terminal at the same time unless you
  188. have obtained a site license from ChaoSoft.
  189.  
  190. If the Registered Copy you are using is registered to anybody
  191. else, you MUST either unregister it by removing the registration
  192. information, or stop using it. Use of a Registered Copy,
  193. registered to anybody else except you (or, for site license
  194. arrangements, to your organization), is in violation of federal
  195. copyright laws.

  197. Multi-User and Network Use.

  199. If you registered the Software for use by multiple users,  you
  200. agree not to use the Program on more computers than the number
  201. specified in your site license. You may install the Program on
  202. computers attached to a network, or remove it from one computer
  203. and install it on a different one, provided there is NO
  204. POSSIBILITY that your copy will be installed or used on more
  205. computers than it is licensed for.  If you have a network, you
  206. don't need to include every computer attached to the network in
  207. your license, but you must include every computer on which the
  208. Program is installed or used, regardless of whether the user of
  209. the computer happens to know that the Program is in use on their
  210. system.  If you have single computers which allow multiple users
  211. to use the Program simultaneously, you must count each keyboard or
  212. terminal separately when determining how many computers are using
  213. the Program.

  215. LIMITED DISTRIBUTION LICENSE

  217. You may make as many copies of the Program as you wish, give it to

  272. Software. You are not allowed to make any modifications to, or to

  274. this software. This includes all the executable, help,
  275. installation, and documentation files, as well as graphics images.
  276. Any such unauthorized use shall result in immediate and automatic
  277. termination of this license.

  279. LIMITED WARRANTY

  281. The following limited warranty applies to Registered Copies of the
  282. Program. This warranty does NOT apply to Unregistered Copies of
  283. the Program.

  285. Satisfaction Guarantee.  If you are dissatisfied with any product
  286. you buy from us under this Agreement for any reason, you may
  287. return it at any time up to 30 days after purchase and we will
  288. give you a refund. Refunds will be based on the price you paid,
  289. with shipping costs excluded.  You must contact us before
  290. returning any product for a refund. This satisfaction guarantee
  291. does not apply to multi-system licenses for more than 10
  292. computers, or to purchases of more than 10 individual copies at a
  293. time.

  295. Physical Defects.  We pledge that the disks, if any, and any
  296. printed material we send you will arrive free of physical defects
  297. which interfere with normal use. If you find such a defect and
  298. report it to us within 30 days after you get your Registration
  299. Package, we agree to replace the defective item(s) at no charge to
  300. you as long as the defect was not caused by misuse or abuse.

  302. Bugs and Program Errors.  We don't promise that the Software will
  303. be free of bugs or program errors, and you agree that bugs or
  304. program errors will not be considered as "physical defects" in the
  305. program. We agree that if you report a program error or bug to us,
  306. we will use our best efforts to correct it.

  354. Maine. The parties hereby consent to in personal jurisdiction of
  355. said courts.
